On 13 February 2009, TCS were informed by the Supply Chain Management Bid
Adjudication Committee of the City of Cape Town ("the committee") that their bid
to continue to provide Traffic Contravention Systems and Services to the City of
Cape Town ("COCT") was unsuccessful. No explanation was provided by the
committee to TCS as the reason why TCS` bid was unsuccessful. TCS are the
current suppliers of Traffic Contravention Systems and Services to the COCT,
which represents a material contract to TCS and has been for the last 5 years.
The tender was awarded to Syntell (Proprietary) Limited ("Syntell").
TCS are in the process of requesting reasons for the decision in order to
consider its position and take whatever steps might be necessary to protect its
interest.
Approximately 12 months ago Syntell, when ordered to relocate their analogue
cameras in accordance with a determination made by the COCT, refused to do so
and informed both TCS and the COCT to this effect. TCS was then informed by the
COCT that TCS were not performing in terms of their obligations due to Syntell`s
non-conformance. TCS then instituted legal action against Syntell for
declaratory and mandatory interdictory relief against Syntell.
The existing TCS contract with the COCT is to be extended for an 18 month period
from 30 June 2009 to 31 December 2010, in order to finalise all offences that
will be in the current system up to and including 30 June 2009.
On 13 February 2009, judgment in the application brought against Syntell was
delivered in favour of TCS, with Syntell ordered to pay TCS`s costs. Syntell was
inter alia ordered to relocate their analogue cameras in accordance with the
determination made by the COCT, within 30 days of the date of the judgment, and
replace them with TCS` digital camera technology.
