1    Failure to notify construction merger                                      
On Wednesday, the Competition Commission, WBHO Construction and Edwin           
Construction will ask the Tribunal to confirm a settlement they reached as a    
consent order. The settlement follows WBHO and Edwin`s failure to notify the    
Commission of a merger between the two firms. When this came to their attention 
the merging parties notified the Commission, which approved the merger in       
September 2009. In terms of the settlement the parties admit that they failed to
notify the Commission of the merger before implementing it, in contravention of 
the Competition Act. WBHO also agrees to pay R1 million and Edwin R100 000.00,  
as penalties for their contraventions.                                          
2    Proposed large merger between the Spar Group and Fraqur 165 and Northern   
Light Trading 128                                                           
In this merger, which is structured in two stages, Spar Group intends to acquire
4 existing Spar supermarket businesses located in Gauteng from Farqur and       
Northern Light. These are Bloedstreet SuperSpar in Bloedstreet Mall, Tsakane    
SuperSpar and Tops Liquor Store in Tsakane Mall, Alex SuperSpar situated in Alex
Plaza as well as Sebokeng SuperSpar and Tops Liquor Store in Thabong Shopping   
Centre. These businesses sell a wide range of fresh and processed foodstuffs and
other household items.                                                          
The Competition Commission has recommended that the Tribunal approve this merger
without conditions.
