NOTICE OF APPLICATION FOR BUSINESS RESCUE
IN THE HIGH COURT OF SOUTH AFRICA
(WESTERN CAPE HIGH COURT, CAPE TOWN)

In the matter between:
JOHN TAYLOR & ASSOCIATES INCORPORATED First Applicant
JOHN ANTHONY TAYLOR Second Applicant
and
PINNACLE POINT GROUP LIMITED Respondent
NOTICE OF MOTION
BE PLEASED TO TAKE NOTICE THAT application will be made on behalf of the
above-named Applicants on Tuesday 28 June 2011 on for an order:
1. that this application be heard as one of urgency in terms of Rule 6(12)
and that any non-compliance with the prescribed forms and service be
condoned;
2. confirming that the Respondent entered business rescue on the date upon
which this application was issued;
3. in the alternative to 2 above; placing the Respondent under supervision
and commencing business rescue proceedings;
4. appointing an interim business rescue practitioner ("the practitioner")
who satisfies the requirements of section 138;
5. alternatively to paragraph 4 above; directions to have a practitioner
appointed after the hearing of this application;
6. directing the Respondent to notify each affected person of this order
within 5 (FIVE) days of it being granted;
7. costs of the application, only in the event of it being opposed.
TAKE NOTICE FURTHER that the affidavit of JOHN ANTHONY TAYLOR filed herewith
will be used in support of this application.
TAKE NOTICE FURTHER that if you wish to oppose this application, you are
required to:
(a) Within two (2) days of service of this application on you, to notify the
Applicants` attorneys in writing that you intend to oppose the
application and in such notice to appoint an address referred to in Rule
6(5)(b) at which you will accept notice and service of all documents in
these proceedings; and
(b) Within 5 (FIVE) days after you have so given notice of your intention to
oppose the application, to file your answering affidavits, if any.
TAKE NOTICE FURTHER that the Applicants have appointed the office of their
attorneys of record as set out below as the place at which they will receive
notices and service of all process in these proceedings.
