NOTICE TO AFFECTED PERSONS IN TERMS OF SECTION 129(3) AND (4) OF THE
COMPANIES ACT 71 OF 2008, AS AMENDED (“COMPANIES ACT”)
Shareholders are referred to the SENS announcement released on Thursday, 27 October 2022
wherein shareholders were advised that the Company had commenced voluntary business
rescue proceedings.
Shareholders are hereby advised that they are regarded as “Affected Persons” in terms of
section 128(1)(a) of the Companies Act and thus are entitled to the notice of the commencement
of business rescue proceedings and the notice of appointment of the joint business rescue
practitioners of the Company.
Accordingly, the relevant notices have been made available on the Company website at
www.tongaat.com under the ‘Business Rescue’ tab.
Shareholders should note that in terms of section 132(1)(a) of the Companies Act, the
Company’s business rescue proceedings commenced on 27 October 2022.
