The Competition Tribunal today, 24 Mar 04 dismissed with costs Caxton's application to the Competition Tribunal to interdict Naspers from buying out minority shareholders in MNet and Supersport and to declare the transaction a notifiable merger in terms of the Competition Act. Naspers claimed that the transaction is not a notifiable merger because it does not constitute a change in control. The matter was heard on Friday 19 Mar 04.
