Kebble says there may still be some “procedural” and “constitutional” matters in the case. “We are still having an ongoing look at the legal side,” Kebble told Mineweb on Monday afternoon, “But we will pay if we have to.” On Friday, JCI, the resource investment company, lost an appeal on a case with DRDGOLD dating back six years, and was awarded to the gold company late last year. The judgement states that JCI must pay DRDGOLD R35.7 million in warehousing fees plus interest and costs. DRDGOLD said that the judge had ordered payment in 48-hours after judgement, which means a deadline of Monday at 5pm Johannesburg time. Mark Wellesley-Wood, DRD’s chief executive, speaking to Mineweb a little after 5pm on Monday, said this: “I spoke with Treasury earlier, and they said they had not received the cheque yet.” Wellesley-Wood said he had been in meetings all day discussing the restructuring of North West. He said possibilities of a phased process were discussed, which would be more affordable and could be in labour unions’ interest. “We could go shaft by shaft, and say “if this part works,” then we do not have to do any more,” said Wellesley-Wood. Besides the JCI money, Debt seems like the financing rout for the restructuring process. “We may have to borrow against our international assets to fund the restructuring,” said Wellesley-Wood
