JOHANNESBURG (Mineweb.com) -- While appeal documentation was expected today by DRDGOLD management in the JCI legal battle, Mineweb understands that JCI intends to pay and will not appeal the court’s decision.

“We will pay the R37 million on Friday,” a JCI spokesman told Mineweb, “JCI wants to make peace with DRD.”

On 25 February, JCI’s appeal against a court ruling ordering it to pay a R35 million warehousing fee to DRDGOLD was turned down. The fee dates back 6 years, when shares in Randfontein Mines were bought by Western Areas, but in DRD’s name. In October the court ordered JCI to pay with interest and legal costs.

Ilja Graulich, a DRDGOLD spokesperson, said he would be checking with his company’s lawyers if they had heard anything. But said that if JCI was going to pay, then “we look forward to receiving the cheque.”

On 1 March Brett Kebble, JCI`s chief executive, told Mineweb that there might still be some “procedural” and “constitutional” matters in the case. “We are still having an ongoing look at the legal side,” Kebble said, “But we will pay if we have to.”
