Premier - Competition Commission application
Premier has noted the Competition Commission's application to the Competition Tribunal to revoke the merger approval granted for Premier's acquisition of RFG Holdings, to refile and reconsider the merger, or alternatively to impose amended conditions. The Commission also sought urgent interim relief to keep the Fruit Products Western Cape canning facility in Tulbagh operating pending a ruling.
Premier strongly opposes the application, denying it acted unlawfully or withheld information. It maintains there was no plan to close the Tulbagh facility at merger time and that closure followed later, driven by the struggling canned deciduous fruit industry, not the transaction.
Separately, the CCMA-facilitated section 189A consultation has concluded. Of 409 affected employees, 407 accepted voluntary severance, two remain, and no retrenchments will be effected. Premier is engaging suppliers and parties interested in repurposing the facility, with shareholders to be updated.
